Welcome to Sarah Munnings Jewellery.

These Terms of Service explain the terms that apply when you use this website, purchase jewellery, make an enquiry, commission custom work or book a service with Sarah Munnings Jewellery.

I’ve tried to keep them clear and straightforward.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot legally be excluded.

1. About Sarah Munnings Jewellery

Sarah Munnings Jewellery is an independent Australian jewellery and creative workshop business based in Melbourne, Victoria.

These Terms apply to:

  • sarahmunnings.com.au

  • purchases, enquiries and bookings made through this website

  • jewellery and custom commissions

  • public jewellery workshops

  • private and mobile workshops

  • corporate, school and community workshops

  • wholesale enquiries and orders where separate written trade terms have not been agreed

Some products and workshops may be purchased or booked through third-party platforms such as Shopify or ClassBento. Those platforms may also have their own terms and conditions.

Where a specific quote, booking confirmation, wholesale agreement or workshop agreement contains additional terms, those specific terms will also apply.

2. Using This Website

You are welcome to browse and use this website for personal and legitimate business purposes.

You must not knowingly:

  • interfere with the operation or security of the website

  • attempt to gain unauthorised access to the website or its systems

  • introduce malicious software or code

  • use the website for unlawful, fraudulent or misleading purposes

  • reproduce or commercially exploit website content without permission

I may temporarily restrict access to parts of the website where reasonably necessary for maintenance, security or technical reasons.

3. Information on the Website

I take reasonable care to keep information about jewellery, workshops, prices, availability, dates and services accurate and current.

Occasionally, however, information may contain an error or become outdated.

If I discover a material error affecting an order or booking before it is fulfilled, I will contact you as soon as reasonably possible and provide an appropriate option, which may include correcting the information, proceeding with your agreement, transferring the booking or providing a refund where appropriate.

Nothing in these Terms permits Sarah Munnings Jewellery to make false or misleading representations about products or services.

4. Prices

Unless otherwise stated:

  • retail prices are shown in Australian dollars (AUD)

  • prices include GST where GST is applicable

  • delivery charges may be added at checkout

  • wholesale prices may be displayed or quoted separately and may be shown exclusive of GST where clearly stated

The total price payable will be displayed or communicated before you complete your purchase or confirm a quoted service.

Prices may change from time to time, but a price change will not retrospectively alter an order or booking that has already been accepted, unless we agree otherwise or there has been an obvious error that needs to be resolved with you.

5. Orders and Payment

When you place an order, you are offering to purchase the products on the terms displayed at the time of purchase.

Payment may be processed by a third-party payment provider.

An automated acknowledgement does not necessarily mean an order has been finally accepted.

An order may need to be declined or cancelled where, for example:

  • an item is unexpectedly unavailable

  • there has been an obvious pricing or listing error

  • payment cannot be processed

  • there are reasonable grounds to suspect fraud or unauthorised use

  • fulfilling the order would breach a legal requirement

If payment has already been taken and I cannot fulfil an accepted order, you will be contacted and an appropriate refund will be provided.

6. Handmade Jewellery

Sarah Munnings Jewellery is made by hand.

Small variations in:

  • shape

  • surface texture

  • hammer marks

  • dimensions

  • colour

  • patina

  • enamel firing marks

  • placement of handmade details

are a natural part of handmade production.

Enamel is glass fused to metal at high temperatures, so individual firings can produce subtle differences in colour, texture and surface.

These natural handmade variations are part of the character of the work and are not, by themselves, faults.

This does not affect your rights where a product genuinely fails to meet a consumer guarantee under Australian Consumer Law.

7. Product Photographs and Colour

I make reasonable efforts to represent jewellery accurately in photographs.

Colours can appear differently depending on your screen, device, lighting and the natural variations of handmade materials.

The piece you receive should reasonably correspond with its description and images, allowing for the handmade variations described above.

8. Availability and Made-to-Order Jewellery

Some jewellery is available ready-made and some is made in small batches or made to order.

Estimated production times may be provided on individual product listings.

These timeframes are estimates unless a particular completion or delivery date has been specifically agreed.

If you need jewellery for a birthday, wedding, anniversary or other important date, please contact me before ordering so I can confirm whether the timeframe is achievable.

9. Custom and Personalised Jewellery

Custom jewellery is created specifically for you.

Before work begins, we may agree on matters including:

  • design

  • materials

  • size

  • colour

  • wording or personalisation

  • approximate timeframe

  • price

  • deposit or payment arrangements

You are responsible for checking names, dates, spelling, measurements and other personalised details before approving them.

Because custom and personalised pieces are made specifically for you, change-of-mind returns are generally not available once work has commenced, as explained in the Returns Policy.

This does not affect your rights under Australian Consumer Law if a custom piece is faulty, does not match the agreed description or otherwise fails to meet an applicable consumer guarantee.

Handmade variations that are consistent with the agreed design and nature of the materials are not generally considered faults.

10. Jewellery Workshops

Workshop bookings are subject to the information shown on the individual workshop listing together with the Workshop Booking Terms and applicable cancellation policy.

Workshop descriptions will generally specify:

  • location

  • duration

  • minimum age where relevant

  • materials included

  • experience requirements

  • what participants can expect to make

  • any special requirements

Most beginner workshops require no previous jewellery-making experience unless otherwise stated.

11. Workshop Cancellations and Changes

The detailed cancellation and rescheduling arrangements for public workshops are contained in the Workshop Booking Terms and Returns & Refunds Policy.

For workshops booked through ClassBento, the cancellation and rescheduling terms displayed on the ClassBento booking at the time of purchase also apply.

Private, corporate, school, community and mobile workshops may have separate deposit, cancellation and final-payment conditions contained in the quote or booking confirmation.

Nothing in a workshop cancellation policy excludes rights that cannot be excluded under Australian Consumer Law.

12. Workshop Safety

Jewellery making involves tools, heat, metal, glass, chemicals and equipment that must be used correctly.

Participants must:

  • follow reasonable safety instructions

  • use tools and equipment as demonstrated

  • wear appropriate clothing and footwear where required

  • tell me about relevant access or support requirements where this is necessary for safe participation

  • behave in a way that does not create an unreasonable risk to themselves or others

If a participant repeatedly or seriously disregards reasonable safety instructions, I may require them to stop using particular equipment or, where necessary for safety, leave the workshop.

Any decision of this kind will be made reasonably and with safety as the priority.

13. Children and Young People

Age requirements vary between workshops depending on the tools and techniques involved.

Where a workshop is open to children or young people, appropriate parental, guardian, school or organisational consent may be required.

The individual workshop listing will state applicable minimum-age or supervision requirements.

14. Private, Corporate, School and Mobile Workshops

Private and group events often involve reserving a particular date, preparing materials and, in some cases, travelling to another venue.

Your quote or booking confirmation may therefore contain specific terms relating to:

  • participant numbers

  • deposits

  • final payment

  • changes to numbers

  • cancellation

  • venue requirements

  • travel

  • materials

  • supervision

Those specific agreed terms will apply to that booking, subject always to applicable law.

15. Shipping and Delivery

Shipping options, costs and other delivery information are set out in the Shipping Policy.

Please provide a complete and accurate delivery address when placing your order.

If you discover an error in your delivery details, contact me as quickly as possible. I will make reasonable efforts to help, but it may not be possible to change an address once an order has been dispatched.

If a parcel is lost, damaged or significantly delayed, please contact me so the matter can be investigated and dealt with in accordance with applicable consumer law and the Shipping Policy.

16. Returns, Refunds and Faulty Products

The Returns, Refunds & Workshop Cancellation Policy explains my voluntary change-of-mind policy and how returns are handled.

Importantly, that policy does not replace your rights under Australian Consumer Law.

Products and services supplied to consumers come with statutory consumer guarantees.

Depending on the circumstances, if a product or service fails to meet an applicable consumer guarantee, you may be entitled to a remedy such as:

  • repair

  • replacement

  • refund

  • correction or re-performance of a service

  • cancellation of a service

  • compensation for reasonably foreseeable loss or damage

The remedy available depends on the circumstances and whether the failure is major or minor.

17. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify a consumer guarantee, right or remedy that cannot legally be excluded.

Under Australian Consumer Law, goods supplied to consumers must, among other things, be of acceptable quality, fit for any disclosed purpose and match their description.

Services must be provided with due care and skill, be fit for an agreed purpose and, where no timeframe is agreed, be supplied within a reasonable time.

These rights apply automatically where the Australian Consumer Law applies.

18. Gift Cards

Gift cards are subject to the conditions stated at the time of purchase and applicable Australian law.

Gift cards are generally not refundable for change of mind.

Nothing in these Terms limits any statutory rights that apply to gift cards.

19. Wholesale Orders

Wholesale customers may be provided with separate trade terms covering matters such as:

  • minimum order quantities or values

  • wholesale pricing

  • payment terms

  • lead times

  • freight

  • custom or exclusive products

  • returns

  • territory or exclusivity arrangements where specifically agreed

Where separate written wholesale terms have been agreed, those terms take precedence over these general Terms to the extent of any inconsistency.

Nothing in these Terms excludes any statutory rights that apply to a business customer.

20. Intellectual Property

Unless otherwise stated, the content on this website—including photographs, text, graphics, jewellery designs, workshop materials, branding and other original content—is owned by or licensed to Sarah Munnings Jewellery.

You may view, share links to and use the website for normal personal purposes.

You may not reproduce, sell, publish, distribute or commercially use substantial website content, photographs, workshop materials or original designs without permission.

Workshop materials

Any handouts, teaching materials, templates or instructional resources provided during a workshop are supplied for your personal learning unless otherwise stated.

You are welcome to enjoy and develop the skills you learn.

However, teaching materials themselves may not be copied, republished, sold or used to deliver another person's classes without permission.

21. Photographs at Workshops and Events

Photographs or videos may occasionally be taken at workshops and events.

Where images identifying participants are intended to be used for promotional purposes, consent will be sought as appropriate.

You are always welcome to tell me that you prefer not to be photographed.

Additional permission requirements apply where children and young people are involved.

22. Privacy

Personal information is handled in accordance with the Sarah Munnings Jewellery Privacy Policy.

Third-party services including Shopify, ClassBento, payment providers and social-media platforms may also collect or process information according to their own privacy policies.

23. Third-Party Websites and Services

This website may link to third-party websites or services, including booking, shopping, social-media and payment platforms.

Those services operate independently and may have their own terms, privacy policies and practices.

A link does not necessarily mean I control or endorse everything contained on the external website.

24. Liability

Nothing in this section limits liability that cannot legally be limited under Australian Consumer Law or another applicable law.

To the extent permitted by law, Sarah Munnings Jewellery is not responsible for loss or damage caused by:

  • misuse of jewellery contrary to reasonable care instructions

  • unauthorised modification or repair of jewellery

  • failure to follow reasonable workshop safety instructions

  • events or circumstances outside my reasonable control where liability can lawfully be excluded

Any limitation of liability in these Terms applies only to the extent permitted by law.

25. Events Outside Reasonable Control

Sometimes circumstances outside either party's reasonable control can affect an order, event or workshop—for example severe weather, venue closures, transport disruption, illness, emergencies or interruptions to essential services.

Where this happens, I will communicate with affected customers as soon as reasonably possible and work towards a fair solution in accordance with the relevant booking terms and applicable law.

26. Changes to These Terms

These Terms may be updated from time to time to reflect changes to the business, website, services or applicable law.

The current version will be published on this website with its most recent update date.

Changes will apply prospectively.

They will not ordinarily change the agreed terms of an existing paid order or confirmed booking unless:

  • you agree to the change

  • the change is required by law, or

  • another lawful basis applies

27. If Part of These Terms Is Invalid

If a provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to operate to the extent permitted by law.

28. Governing Law

These Terms are governed by the laws applying in Victoria, Australia, together with applicable Commonwealth law.

Nothing in this clause limits any right you may have under applicable law to bring a claim in another jurisdiction.
